The privacy of our users is very important to us and we are committed to protecting it. This Privacy and Cookies Policy (the “Policy”) explains how we collect, store, and use your personal information.

This Policy applies only to the information collected on this website. We are not responsible for the privacy policies, actions or content of any third party resources.

1 Definitions of terms

1.1 Dystlab, Licensor is a trademark registered in the State Register of Certificates of Ukraine for Trademarks and Service Marks on February 26, 2018, certificate No. 238304. The rights holder is an individual entrepreneur Artomov Vitalii Yevheniiovych (EDRPOU/INN 3003314690), who operates business in accordance with the current legislation of Ukraine. The address and other details of Dystlab are listed in the section “Address and details”.

1.2 Dystlab is the “Controller” within the meaning of the EU General Data Protection Regulation 2016/679 (EU General Data Protection Regulation, hereinafter referred to as the “GDPR”), as well as the “Personal Data Owner” within the meaning of the Law of Ukraine “On Personal Data Protection” dated 01.06.2010 No. 2297-VI.

1.3 Site, website means an information resource located on the Internet, unless otherwise specified.

1.4 The User, the Personal Data Subject (hereinafter referred to as “you”) is a legally capable individual who has reached the age of 18, whose data is processed by Dystlab under this Policy.

1.5 Account - an account of an individual or legal entity on the Website that provides access to certain sections of the Website and/or access to download materials. The Account contains personal information about the user, which is regulated by this Policy.

1.6 Subscription is an information service that Dystlab provides to you for a certain period of time, according to the chosen subscription plan.

1.7 Personal data - information or a set of information about an individual or legal entity that can be clearly identified by them.

1.8 Personal data base means a named set of organized personal data in electronic form and/or in the form of personal data files.

1.9 Consent of the subject of personal data is a voluntary expression of the will of an individual (if informed) that he/she gives permission to process personal data in a clear and precise form. The consent of the subject of personal data may be provided during registration on the Website by checking the box on granting permission to process their personal data.

1.10 Processing of personal data means any action or set of actions on data, including the use of information (automated) systems. This may include the collection, registration, accumulation, storage, adaptation, modification, updating, use, dissemination (distribution, sale, transfer), depersonalization, destruction of data, etc.

1.11 Personal data controller, operator - an individual or legal entity that is authorized by the personal data controller or by law to process this data on behalf of the personal data controller.

2 Legislation governing the processing of personal data

2.1 The processing of your personal data is carried out in accordance with the requirements of the current legislation of Ukraine, including the Law of Ukraine “On Personal Data Protection” dated 01.06.2010 No. 2297-VI, as well as international treaties of Ukraine, ratified by the Verkhovna Rada of Ukraine.

2.2 The processing of personal data of users to whom Dystlab provides services within the European Union (including those related to the monitoring of user behavior within the EU) is carried out in accordance with the EU General Data Protection Regulation 2016/679 (hereinafter referred to as the “GDPR”).

2.3 The legislation of the states with whose residents we have contractual relations may establish additional requirements for legal regulation of relations specified in this Policy.

3 Privacy Policy

3.1 We openly inform you that we process your personal data and take all possible and available actions to protect your personal data.

3.2 We process your personal data only if you have given your explicit consent to the processing of personal data as specified in Article 6 of the GDPR or Article 11 of the Law of Ukraine “On Personal Data Protection”.

3.3 Before you start using the Website and/or Dystlab services, including downloading materials from the Site, you must read this Policy and express your full agreement with it.

3.4 If you disagree with this Policy, you must refrain from using the Website and leave it.

3.5 We may update the Policy from time to time, so we ask you to visit the Website to make sure you have the latest information.

3.6 Personal data and information we collect

3.6.1 We receive the information you provide to us when you register your Account on the Website, through the feedback systems, by e-mail or otherwise.

3.6.2 From the information received from you, we store the part of it that is necessary for us to provide quality services or fulfill our obligations under the Public Offer Agreement (for example, personal or non-personalized identification information).

3.6.3 Personal data may be collected and processed automatically, including through cookies.

3.6.4 Personal data includes information that allows you to be identified among other individuals. This includes:

- your first name, last name, patronymic (if any);

- the country you live in;

- date and year of your birth;

- your photo;

- your position and the name of the business entity, enterprise, institution or organization that you represent or of which you are the owner, founder or participant (have worked or are working);

- your postal address, e-mail address, contact phone numbers, identifiers of other means of communication;

- any other personal information that you enter during registration on our Website or send to us in any other way.

3.6.5 Non-personalized identification information

3.6.5.1 Non-personalized identification information - statistical data that does not by itself identify specific individuals or legal entities and which depends on visits to the Website. For example, this information may include the IP address from which you access the Internet, the date and time of access to the Website, etc.

3.6.5.2 Non-personalized information may be stored in our contact or administrative databases because we believe that you may be interested in receiving materials from us about our activities and services. This allows us to more effectively manage our relationship, improve our online resources and services, and target the materials we may send you by interest.

3.6.5.3 We may receive information about you from other sources, including publicly available sources of personal data: directories, address books, registers, lists, catalogs, databases, other systematized collections of open information containing personal data posted and published with your knowledge, as well as from third parties who help update, expand and analyze our records; identify persons interested in our services; prevent or detect fraud.

3.6.5.4 In accordance with Article 7 of the Law of Ukraine “On Personal Data Protection”, we do not collect information about racial or ethnic origin; political, religious, ideological beliefs; membership in political parties and trade unions; convictions to criminal punishment; data related to health, sexual life, biometric or genetic data, etc.

3.7 Purposes of processing and using personal data

3.7.1 We provide information services both in Ukraine and abroad.

3.7.2 We need your data to support a wide range of processes, including:

- registering and/or logging into your Account;

- organizing access to free materials published on the Website;

- organizing access to materials distributed by paid subscription;

- checking the status of an active subscription, generating a list of previous subscriptions (history);

- responding to comments, feedback, messages;

- ensuring security and countering fraud attempts and illegal actions with digital data;

- providing effective customer service and a better understanding of your needs and interests;

- personalize the use of our Site;

- providing you with information that we believe may be of interest to you;

- providing you with information and notifications regarding your use of our Website (for example, in the form of statistics);

- improving the content, functionality, and usability of the Website;

- improving our services;

- other purposes specified in this Policy and the Public Offer Agreement;

- resolving any problems that may arise regarding the terms and conditions of service, etc.

3.7.3 As a rule, required and optional requests for personal data from us are visually separated. Thus, the fields for entering required data on the Website may be marked with a special symbol “*”. However, we are equally strict in protecting both required and optional personal data. Therefore, if you decide to provide us with additional (optional) personal data, we guarantee that it will be processed with the same level of protection.

3.8 Data protection

3.8.3 We use generally accepted standards of technological and operational protection of information and personal data against loss, misuse, alteration or destruction. However, despite our best efforts, we cannot guarantee absolute protection against any threats arising outside of our control.

3.8.4 We strive to provide the highest level of security to prevent unauthorized or unlawful disclosure (including processing), accidental loss, destruction or damage to your personal data.

3.8.5 We provide access to information and personal data only to authorized employees who have agreed to ensure the confidentiality of such information and data in accordance with our requirements.

3.8.6 Dissemination of personal data without the consent of the personal data subject or his/her authorized person is allowed in cases determined by law and only (if necessary) in the interests of national security, economic welfare and human rights.

3.8.7 We are responsible for the processing of personal data received in accordance with the requirements of applicable international law and the legislation of Ukraine and impose similar obligations on persons who have access to personal data (including those who process it) and counterparties with whom we interact in the process of providing you with services or processing information received from you.

3.9 Using special features and password-protected sections

3.9.1 The Website may contain special features and password-protected user accounts.

3.9.2 In order to use special features or password-protected areas, you may be required to agree to specific terms and conditions governing the use of such features. Such consent will be requested by means of an “I Agree” checkbox or similar mechanism that confirms acceptance of the terms.

3.10 Cookies

3.10.1 To make your stay on the Website as comfortable as possible, we need to analyze the behavior and interests of users. This analysis is performed using cookies. In particular, we use these technologies to:

3.11.2 You have the right to access your personal data and settings at any time to make changes to them or delete them. You can do this directly in your account (user account). Exceptions are periods of maintenance of the Website (updating, restoration), as well as the complete closure of the resource.

This applies, for example, to the complete deletion of your account and your personal data from the Website. After your request, the Website managers will check the information in the request and respond promptly.

3.12 Transfer of personal data to third parties

3.12.1 We do not sell, rent, or provide your personal data for commercial purposes to third parties.

3.12.2 We have the right to disclose personal data only when such disclosure complies with the current legislation of Ukraine and international legislation in the field of personal data protection (for example, to IT providers or cloud service providers).

3.12.3 If necessary, personal data may also be provided to state and local authorities, courts, government agencies and law enforcement agencies.

3.13 Data storage period

3.13.1 We will not retain your data for longer than is necessary to fulfill the purpose for which it is processed or to comply with legal requirements.

3.13.2 The storage period is determined by the category of personal data and the purposes for which they are processed.

3.13.3 As a general rule, the maximum processing time for personal data in Dystlab is 2555 days from the date of submission of tax reports for the period in which the relevant transaction took place. The specified processing time complies with the provisions of the Tax Code of Ukraine regarding the period of storage of documents related to the calculation and payment of taxes and fees.

3.13.4 Personal data shall be deleted or destroyed from personal databases in cases established by the legislation of Ukraine and/or international law.

3.13.5 We make changes to personal data at your request if the current data is unreliable or inaccurate.

4 Other terms and conditions

4.1 Rights of the personal data subject

4.1.1 You have the right to:

- know about the sources of collection, location of their personal data, the purpose of their processing, location or place of residence (stay) of the owner or manager of personal data, or give a corresponding order to obtain this information to their authorized persons, except in cases established by the legislation of Ukraine and international law;

- receive information about the conditions for granting access to personal data, including information about third parties to whom your personal data is transferred;

- access their personal data;

- receive information about whether and how your personal data is processed;

- submit a reasoned request to the personal data controller with an objection to the processing of their personal data;

- submit a reasoned request to change or destroy their personal data by any owner and administrator of personal data if this data is processed illegally or is unreliable;

- protect their personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision, as well as to protect against the provision of information that is inaccurate or discrediting the honor, dignity and business reputation of an individual;

- file complaints about the processing of their personal data to the Ukrainian Parliament Commissioner for Human Rights or to the court;

- apply legal remedies in case of violation of the legislation on personal data protection;

- make reservations regarding the restriction of the right to process their personal data when giving consent;

- withdraw consent to the processing of personal data;

- know the mechanism of automatic processing of personal data;

- protect yourself from an automated decision that has legal consequences for you.

4.1.2 If you contact us for clarification of any of the provisions of this Policy, including clause 4.1, we will respond no later than thirty (30) calendar days from the date of receipt of the request (except as provided for by the laws of Ukraine and international law).

4.1.3 You may use other rights in accordance with international law and Ukrainian legislation on personal data protection.

4.1.4 If personal data is deleted at your request, we will retain only such copies of the information as are necessary to protect our legitimate interests or those of third parties, resolve disputes, or perform any transaction pursuant to any agreement you have entered into with us.

4.2 Safety of minors

4.2.1 Website is not intended for persons under the age of 18.

4.2.2 We do not use our Website to knowingly transfer data from and to persons under the age of 18. If you are under 18, please do not provide us with any personal information. If we determine that a person under the age of 18 has provided us with such information, we will use reasonable efforts to remove that information from our databases.
